My apologies for the delay in getting back to you; I have been ill.
I purchased my Canon PowerShot A40 from you by mail order on Monday 6th January 2003. On Friday 25th April, I returned it to you under warranty as it was not working.
On Friday 9th May, you called to tell me that Canon have returned the camera to you claiming 'water damage', and that this exempts them from repairing the camera. When I asked for substantiation of this claim, I was sent only a copy of the quote from Canon with the words 'Water damage' on it - nothing else. This does not substantiate the claim in any way; furthermore, if liquid has condensed in the camera, this would indicate defective or inadequate sealing in the camera - that is to say, a manufacturing defect.
I bought the goods from you - my contract is with the Digital Camera Shop (Sale of Goods Act 1979), not with Canon. Under the Limitations Act (1980), the shop is liable if the problem is down to an unreasonable fault (e.g. it stops working and the manufacture refuses to honour the guarantee, or the claimed cause of the fault is in fact due to a manufacturing defect). Also, the manfacturer's warranty was part of the advertised description of the goods on your website, and is stated as applying on the invoice.
As such, I require one of:
- Repair of my PowerShot A40, or a replacement Canon PowerShot A40 in good working order, under a similar warranty to the original purchase;
- Refund of the purchase price of the camera (£199.00);
within fourteen days.

I realise it's Canon's fault, not the shop's, but I can't afford to be that generous.
I was going to accept credit instead of a new camera or money back, but we really don't have the money to make up the price differential on such luscious and desirable items as this, this or this. So it'll be taking the money and looking for somewhere that still has the Ixus v2 in stock.

Date: 2003-06-23 03:52 am (UTC)If you want a padded water-resistant all-round nice padded pouch to carry it in, go to somewhere (Millett's) that sells Lifeventure stuff and get the little padded phone/camera case that is the right size. It's precisely the size for the camera and a spare battery in the bottom, and it's very good protection.
